It's called insurance fraud and is a felony. Whether or not the district attorney will or can do anything is unknown; this is more properly governed by the state and if you contacted the particualr insurer who paid off, they would be delighted to insure this conduct is prosecuted. You say you are in Illinois, and I am sure that there is an itnernet site for the Department of Insurance and likely a "fraud" hotline where you can report the conduct. Remember, if you do nothing and ultimately this scheme is uncovered, the authorities will likely assume you were "in on it."
