Legal Question in Real Estate Law in Illinois

Home Inspection

I was going to purchase a home but did not because the inspector told me there was a fire. This was not disclosed to me by the home owner. I informed my attorney I did not want to buy the home mainly because of the fire but there were also many problems. The home owner wants to see the inspection report. I did not want to show her because I paid for the inspection and the owner knows I am backing out because of the fire. However, my attorney who is friends with the home owners attorney said I have to show the inspection to the home owner. Do I have to provide this information?

Re: Home Inspection

No you don't unless the seller wants to pay for it.

Re: Home Inspection

I'd have to see your contract to give you a certain answer. However, generally the home inspection contingency requires that you show the Seller it if you're going to invoke it to ask for repairs or to get out of the contract. Note, there's also generally only a 5 day window to invoke that right after the contract has been signed.

Re: Home Inspection

Generally, if it is the basis for you to cancel the contract, it should be provided.
