Can my Home sales profit be held hostage?

I'm due to sell my home next week, I have about 30K of equity of which about 12K goes to lienholders and I was supposed to get the rest of the money. @ weeks ago, I was charged with misdemeanor home violence against a family member who was living with me. The question is, ''Do they, no , strike that, shouldn't this be a matter of civil law?

I need that money to live, buy a car, bills... Thank You
