Legal Question in Real Estate Law in Illinois

Whose house is it??

Our family established second mortgage so my brother could build home on property owned by he and his girlfriend. Things didn't work out and he wants to leave....what can he do with house and mortgage ?? Girlfriend wants to stay in house and have him pay mortgage. She is not on Mortgage. Property is in both of their names.

I bet they did this without a lawyer. I don't think there are any lawyers out there so stupid as to set this up in the way you described. Well, now they have to go to a lawyer to straighten this out. This is too complicated a situation to give a simple answer here. All I can say is when one is too cheap to spend money to have the deal done right the first time, they are doomed to spend much more to fix what they screwed up.
