Legal Question in Real Estate Law in Illinois
My husband and I have been married less than a year and are currently separated. He has lost his job and is struggling with illness due to alcohalism. He is working with unemployment but so far he is still waiting. In the meantime, I have owned a townhome since before I met him and we own the house we lived in together. I have been unable to pay both mortgages, medical bills and all the other bills we have. We decided to sell the house we both own, probably short sale, but try and get out from under it. He has since decided to let it go into foreclosure. I do not want to do this but I can't afford both mortgages and I can't sell without his signature. We are located in Illinois. Is there anything legally I can do to try and salvage my credit since he won't cooperate? I would get an attorney but unfortunately I am not financially able to get representation yet. I just want to find out if I have any options before I invest alot of money. Thank you for your time. -vicki

Finishing the process and getting a divorce would seem to be the best course. Your credit would take a hit anyway but it would be more understandable to the outside world if it was "covered" by a divorce.
