Legal Question in Real Estate Law in Illinois
My husband and I are renting an apartment from his mother whose house is in foreclosure. They have just sent us an intent to evict scheduled for 3 weeks from today. Is there something that can be done to provide us more time to move since we're tenants and have a lease?

The law is that you have the right to stay in a rental unit that has gone through foreclosure even if it is sold at the foreclosure sale, through the end of your lease term UNLESS the buyer intends to physically move into the place in which case you can be evicted if you don't voluntarily move out after proper notice. But without more information, it's impossible to tell at what stage of the game you are at: did the buyer notify you of their intent to move in? What kind of notice did you receive, etc. To property address your issue an attorney should review the lease and all the related paperwork.
