Legal Question in Real Estate Law in Illinois
Illinois Homestead Property
I recently received property from a relative by Quit Claim Deed. On the quit claim deed is the clause ''hereby releasing and waiving all rights under and by virtue of the Homestead Exemption Laws of the State Of Illinois.''
My relative was executor and sole heir to the property that originally belonged to a deceased relative.
I searched probate court records because the deceased relative did leave a will in which my relative was named as heir and executor of the property.
On the Executors Deed is the statement ''This is Not Homestead Property. Are my rights of ownership affected by this statement?

Re: Illinois Homestead Property
No...it's essentially overkill. If the person you got the property from didn't have homestead rights then there was nothing to waive. A non-issue.
