Legal Question in Real Estate Law in Illinois

I am in Illinois and 2 years ago we put earnest money on a house, but after the inspection we decided to back out of the contract. We backed out in enough time, but Fannie Mae insisted on keeping the money. Our realtor tried reaching out to the banks realtor to get our money back with no help. Is it too late for us to try and fight for our money still?
