Legal Question in Real Estate Law in Illinois
Already in Judgement, need help
My sister and I had an apartment in Bloomington Il. Towards the end of the lease we were having problems making our rent. My sister and I gave verbal notice to our landlord after our lease was up and we were still behind in rent. We moved out and then a month or so later after trying to make arrangements to settle our debt we found there was a judgement against us for rent owed, legal fees, etc. in the excess of 2,400.00, when our rent owed was just $800.00. Their lawyer states that they evicted us, which we did not receive a summons to evict and we had already left the premises. Within the past year my sister is still trying to send money to their lawyer. He has returned the money with a letter stating that they will not take those payments and that they will only accept the full amount. What should we do to keep them from continuing this mess.
We just want to pay this as fast as we can and get it over with. Please call or something as soon as possible!!!

Re: Already in Judgement, need help
There are a couple of things going here. First, the judgment MAY be no good as there is no personal service. This may be inconsequential as even if there was no personal service, you still owed the landlord some money. The attorney is within his right to demand only full payment; that way, he keeps the interest clock running. I don't know any lawyers in Bloomington; however, I would advise you to contact the county bar association and ask for a referral. GOOD LUCK!
