land developer not keeping promises

what is customary for a land developer of a subdivision as far as charging us for everything that he hasn't yet delivered? There are many big things that he has not delivered. He tells us things like''We can fix that and it will cost us $$$.'' I didn't think that we had to pay the development costs. My take is this. If the developer said we would have a 23 acre ski lake and its only 16 and it leaks is that our problem? He told us he only owes us a hole. There was an article on his website, in the local paper about our subdivision in it it states we would have a 20 ft. berm between us and the highway. It is only 6 ft tall in a hugh area. our quote 250,00 to put up a wall. He told us it would be 20 ft. But their is nothing in our written contract. would the letter on his website from the paper and what he told us be enough to use in a court of law?He got wind last year that we were talking of sueing him. Therefor he and the LLC voted them selves back into the HOA to be in control again. They had extra votes as developers on unsold lots. So here we are Us against them it doesn't make for a good neighboorhood. We are tired of hearing their is nothing wrong with the lake. Sent him a letter of reservation last year. before the turnovover
