Legal Question in Real Estate Law in Illinois
My landlord has not fixed the flooding in the basement for over a year.Our original move in date was pushed back due to this same leak/flood. We were told it was fixed after loosing many of our things due to water issue we realized they lied to us.We asked for repairs to be fixed with every months rent ck. On Aug.18th 2010 at 4:25PM P was told "all the needed repairs on the home will be made within 30 days"Several certified letters later still waiting. Now :Landlord is trying to charge exrtra Maintanence fees,also tried to charge us twice for water bills as well as after signing 2 yr lease tried to charge us second security deposit.When questioned the response was "someone in the accounting department must have made a mistake" Funny how that same mistake has been made several months in a row,Not to mention the fact they faulsified dates on recent ducuments.

Take your lease to an attorney with these facts. Answer the attorney's questions as to other information needed. This is way too complicated for this kind of on-line forum but it does sound like you have sustained compensable damages or may have accrued the right to declare a constructive eviction (but may have lost that right by failing to act quickly). As to property loss, hopefully you has some renter's insurance? Landlord can only charge you fees that are described in the lease.
