my lease states "This lease shall automatically renew for an additional period of 1 year per renewal term, unless either party gives written notice of the termination no later than 30 days prior to the end of the term or renewal term. The lease terms during any such renewal term shall be the same as contained in this lease". I sent my landlord a certified letter on January 12 2011 that I would be out on or before Feb 16 2011. My lease renews on March 16 of each year. My landlord says I can not move out till March 1 2011. Am I breaking the lease by moving out Feb 1 2011?

You can move out anytime you like. I imagine the real problem here is how long you are obligated to pay rent. Based on the information you have provided, specifically that your lease renews on March 16, I would have to say that you are obligated to pay rent until that date. Obviously, my answer might change if I had the opportunity to review the entire lease.

Based on the information provided, your obligation to pay for your lease and to maintain the premises ends on March 16, 2011. Of course, you can move out anytime prior to that date.

Based on your information, this is a clause that allows you not to renew, not terminate early. You are liable for rent and other tenant obligations through the end of your term, just not beyond. If you want to move early for your convenience, you can subject to any reasonable move-out rules.
