leasing an aprtment.

i have a question about leasing an apartment, my dad recently had problems where he didnt use a lease or anything just a verbal agreement, and had to pay lawyer fees, loss of rent for over 3 months on 2 apartments, now he wants to use sometype of a lease, credit check.

im in cicero, illinois.

Do lawyers do this leases or can i just pick one up at the local office stores?

Of course you should use a written lease and do a credit check. Yes, you can find lease forms at a stationery store. But even though a lawyer might start out using a printed form... that is usually the way I start out as its cheaper for the client... it will probably be embellished to fit the situation. I would use a lawyer.

Let me answer your questions in 2 parts.

First, you can find a form lease in an office store.

Second, using a form can offer some protection but can also open your father up to possible liability. you must make sure that you perfectly understand the language in the document as well as terms that are not included in the document. Further, a form may not comply with state specific law regarding a landlord-tennant relationship.

Your decision should be based on how much assurance you want to provide for your father. A form is useless if an opposing attorney can find the holes that are sometimes present.
