Legal Question in Real Estate Law in Illinois
I live in Berwyn, IL where I rent an apartment from a private landlord. Per my lease, rent is due the 1st of the month and there is a $25 late fee if rent is paid after the 5th of the month. My landlord has, as of late been charging me $5 a day for each day after the 5th that rent is not received along with the $25 late fee. As a private owner, is he able to legally charge those exhorbitant fees, especially if it is not in my lease?

If the $5.00 charge is not in the lease, then he can't charge it. I would tell him that by charging that fee he has broken the contract (Lease = a contract for a time estate in real estate.) and that you can move out.
