Legal Question in Real Estate Law in Illinois
I live and owe a condo in a three unit building. Unknownst to me, my neighbor fired our assocation and is managing the building himself. I found this out through my association. I asked him to forward all information including the budget plan to me as soon as he receives it from our old association. I paid a full year in advance and want to know how my money is being handled. My question is, in a legal sense do I had the right to access the accounts and see how the money is going in and out and I am pretty sure that he is no longer paying his share of the two units since he has complete access to everything. Yes under Section 19 of the Illinois Condominium Property Act you can inspect, review and copy just about all information and documents relevant to you as an owner for a "valid purpose". There are some exceptions in that Section. To determine your financial stake in the Association would be a valid purpose. It must be in writing and given to whoever the Board is. You are entitled to inspect...at all reasonable times. If the Board is self-managed and refuses (failure to respond in 30 days is a refusal, you can sue and get attorney fees and court costs).
