Legal Question in Real Estate Law in Illinois
Mechanic's Lien
I filed a mechanic's lien in 2004, the property has since been sold and the title company is holding the funds in an account. The reason for the lien is because this individual brought the matter concerning his property because he had received a letter from the State's Attorney Office stating that if he did not clean up his property and the tenants, this property would in fact be taken from him, and/or be fined, imprisoned etc. I took over managing this property cleaned the property from top to bottom and inside and out. As I mentioned in the beginning the property has been sold and I feel this person is receiving funds that he is not rightfully belong to him--unjust enrichment. I have to appear in court next month, what should I do and is there anything about unjust enrichment in the law books so I can receive what I have worked for?

You most likely are entitled to be reimbursed but I must first review what happened. Give me a call to discuss.John
Re: Mechanic's Lien
Depending on what date in 2004, you might be out of luck. You generally have two years to foreclose your mechanics lien. If your two years aren't up yet, contact an attorney and get cracking on this right away!
