Legal Question in Real Estate Law in Illinois

Mechanics' Lien in Illinois

We are in the process of doing a massive re-modeling job on our home and having been paying the general contractor directly for work performed. The draws he has collected were to be applied to specific sub-contractors outlined in our sworn statement. I have just discovered that he has not been paying his subs for 6 months and now they are threatening to place liens on our house. What means of protection do we have?

Re: Mechanics' Lien in Illinois

You can sue the general, report the general to the staes attorney and withhold future payments and pay the subs direct with waivers. In the future, insist on signed waivers from the subs before paying the general.
