I recently found mold growing on and inside of an outside wall in my condo unit (in my infant's bedroom). The drywall & insulation was removed and the area disinfected by a specialty company. The insulation & drywall were replaced by the association. A large crack in the outside wall bricks was replaced/repaired by the association. The association says they are not responsible for the cost of the specialty remediation company that dealt with the mold. At first they said it was our responsibility to fix the insulation & drywall. Then they agreed to fix it to the ''before mold'' condition. They claim the remediation was unnecessary, but the levels of mold were thousands of times higher than an expected level for the area. Approximately $4200 was spent on remediation & testing. We were unable to live in the condo from the time of discovery until the time of remediation (approx 2 weeks). Since the source of the water and subsequent mold was due to an outside source-large crack in the outside bricks (no pipes in these walls), isn't the condo association responsible for paying for the remediation?

Yes, it would seem so based on the facts you presented regarding the source of the leak and subsequent damages. There may be other facts.
Would you ask for a written reply to your written demand for payment of the $4200? Do you need a lawyer?
