Legal Question in Real Estate Law in Illinois
Someone took out a mortgage in my fathers name and used it to buy a house. Does my father now legally own the house? Since we know where it is can we go over there and legally take it?

Based on these facts, no, and no. Someone will have to actually look at the paperwork and most likely ask a bunch of questions in order to make any sense of this -- taking out a mortgage in someone else's name sounds more like fraud.
