Legal Question in Real Estate Law in Illinois
I have a mortgage on my home and have paid on it for 18 years. Can I add my daughter to the mortgage and the deed? Or do I have to wait until it is paid off in order to add my daughter to the deed? She is currently contributing to the mortgage and upkeep of the home.

There is no real need or good reason to add her to the mortgage. To give her ownership in the property, you would have a deed prepared which would deed an ownership interest from you to her. Most attorneys can help you with this for a very small fee. Sometimes there can be some negative consequences to adding children to your property, so those issues should be discussed with your attorney too.
You should be aware that if you add her to the deed, doing so could trigger an acceleration in your mortgage. In other words, the mortgage holder or servicer could demand that the mortgage be paid off. Usually that does not happen, however, you do need to be made aware of the possibility.
