Legal Question in Real Estate Law in Illinois
Mortgage/Death
My fiance recently passed away and we were both listed on the mortgage (paying half each). I've contacted the mortgage company to let them know, but they are saying that they can't help me with out the loan going past due...but I don't want to mess up my credit; but I'm not going to be able to keep paying the mortgage on my own. Any suggestions?

Re: Mortgage/Death
Assuming that you owend the property with rights of survivorship, or she had a will and gave you her share if you owned it as tenants in common, you need to place the property up for sale asap, keep up to date on the payments if you can. If you were tenants in common and not named in a will, you need to find out wh her heirs are, as they are co owners with you presently.
Good luck!
