Legal Question in Real Estate Law in Illinois
My Mother passed away, her house is in foreclosure. I have been named in this lawsuit as an heir. Is it possible they can make me pay for the house if I did not sign a mortgage with her? I received documentation which looks as though the firm filing the lawsuit is now asking that an attorney they chose be assigned as my dead mother's representative and that his bill be added to the indebtedness on the house note. Is this possible? Please help. Thank you.

You cannot be personally liable for any debt if you did not sign the promissory note. You are being named in the foreclosure because you have an interest in the real estate, and the lender wants to terminate that interest so the lender eventually can sell the real estate. The appointment of an attorney to represent the estate's interest is required, unless you wish to hire an attorney for the estate. If there is any equity that you wish to preserve, you should contact an attorney directly to assist you.
