Legal Question in Real Estate Law in Illinois

Someone tried to move into my apartment without my consent. It is against my lease to have another person to move in with me. The other person was basically a squatter. For two weeks I asked them to remove their property from my apartment and they refused. Fearing that I would be throw out of my apartment while I'm pregnant, I removed their stuff myself. They are now suing for damage property. They didnt pay me anything and we didn't have a written agreement for it to be there. Could they win the lawsuit?

Yes, they could.

First, you say they they "tried" to move in..... No, it sounds like they DID move in. Once "in", they may be entitled to process of law to be removed. Paying rent is a sign of a tenancy, but is not always the only way a tenancy can be proven.

As to the personal property, yes there are rules about what you can do with the property and normally you can't just throw things out that belong to other people, even if it is on your property.
