Legal Question in Real Estate Law in Illinois
If a munincipal takes me to trial to attempt to demolish my building, after the trial it is ruled that the court had no jurisdiction because the proper parties were not on the lawsuit. Can I sue for attorney fees and expenses? Illinois - Mchenry County

You should ask your attorney, since he or she is familiar with the facts of this case. Unless there is a statutory right or contractual agreement that the other party pay your attorneys fees, then no, your attorneys fees cannot be assessed against the other party. In certain very limited circumstances, courts will sanction the other party and may assess attorneys fees. Again, ask your attorney if this would be such a case.
