Legal Question in Real Estate Law in Illinois
Pet Agreement Changed
My condo association laws used to let the owners have pets, they have recently passed a law that now we can not. Can I fight to keep my cat?

I wouldn't give up so easily. Make sure proper notice was given prior to the meeting regarding this change. I'm sure you would have noticed something in your mailbox that said there would be a vote as to whether you could have pets there. An argument could also be made that you purchased this property based on the fact that you could have a pet, and I'll bet you wouldn't have purchased it if you knew it meant giving up your cat. They have effectively taken something away from you without compensation. I can't imagine what kind of sick b!@#!@#d would want to make someone give up their pet. I wish I practiced in your area of the state. Fight like hell!
Re: Pet Agreement Changed
The way you could have fought to keep kitty was to attend the condo association meeting at which this modification/change to the rules was voted upon. Check carefully to see if current pets were "grandfathered" in, thus the new rule not applying to your pet. Otherwise, find a good home for kitty.
