Possibly unlawful five day notice
We are appt. renters. Our gas bills are supposed to come on a monthly basis, but we were not billed for the time period from 5/99 to the present. On Sept. 24th we were sent a notice saying that no, we weren't billed for these months, but payment in full of the total amount was being demanded of us. There is no due date on this letter for payment, exact wording is "Prompt payment will be greatly appreciated." On Oct 9th we received a hand typed, not notorized, folded and stapled 5 day notice stuck in the crack of our front door. The notice is dated Oct. 7th, and payment in full is being demanded or our lease will be terminated in 5 days. We were never notified that there would be a lapse in the billing, and never given a date due for payment. Our lease also states that 30 written notice is required prior to termination, the time frame from the bill we recieved up to the 5 day notice was 2 weeks! Can they legaly evict us based on the information I have given? We have no other outstanding depts with our lessor.

Might I assume that you receive a gas bill not from the utility but from your Landlord? If so, I can see a couple of defenses here. YOU SHOULD CONTACT A LOCAL LAWYER IMMEDIATELY!! I believe that the way this might resolve is that you will have to spend money for the gas actually used, but not all at once.
