Not sure I understand, but I'll try: So you and a neighbor share a private road and they are allowing field water to flood the road? Well if this is the issue, it all depends whether there were any documents or agreements that set up the road. If so they have to be examined. If not then whatever use is reasonable and does not damage the road should be ok. Hope that helps. If not repost with clearer information.
