Legal Question in Real Estate Law in Illinois

Problems with Real Estate Agent

Our realtor listed our home on the market without our permission, and set his own price for $199,900. Not knowing about this we then listed the house 4 months later when we were ready to sell at a price of $229,900. So now any perspective buyer is being told by their agent that the home comes up listed at $199,900 but then changed to the higher amount, $30,000 higher, which leads the buyers to beleive that there was a $30,000 remodel done, and of course when they arrive they see absolutely nothing brand new in the home. I beleive this has cost us alot of offers on the home. It has mislead agents and buyers as well. We've been showing the house for almost a year and got one ridiculously low offer, which was so insulting we couldnt figure out why. We found this out by another realtor who informed us that the home was listed 4 months before we authorized our agent to do so. What if anything can we do about what this agent has done. We were told that the misinformation cannot be removed from the database.

Re: Problems with Real Estate Agent

The big question is, how did the real estate agent list the house without your permission? Did you sign a listing agreement? If the real estate agent did engage in some impropriety, you probably need to talk to the broker (i.e., the agent's boss). I'll bet there is some way to correct that database if someone put a little effort into it. You would be well served to contact a real estate attorney in your area.
