Legal Question in Real Estate Law in Illinois

Procedures for lien

I was sent what I understood as being the first step in putting a contractors lien on my house. It was a furnace and a/c installation. I never recd anything further and now doing a search, find he did place a lien for $2,000.00. He was fired and I had to hire another contractor to complete the job, which cost me more than I would have originally paid. The original contractor's company shows dissolved in 2005 with the Secretary of State. How do I fight this lien? He does not deserve this money. I filed a complaint with the BBB and am still fighting with Goodman over what I believe is a defective furnace. Do I have to go to court? I don't know what to do and can't afford more fees for legal representation at this time.

Re: Procedures for lien

If all they did was file a mechanic's lien, it is only valid as a lien against your real estate for two years. There are a number of other things you can do to get rid of this lien, but they all will cost you some money. If it was filed in 2005, it either already expired or will soon.

Re: Procedures for lien

A lien only lasts for two years so it may have expired - if not, you would have to take him to court to force this off your home's record.
