Legal Question in Real Estate Law in Illinois
Property Damage.
A Contractor/Homeowner built a house across the street. The sanitary district damaged my yard and have done an insifficient job of repairing my property. The contractor/homeowner hired someone for snow removal and he pushed gravel/snow into my yard this winter and the contractor/homeowner has yet to remove the debris from my yard or fix the damage.
What can I do to recover damages from him?
Is there a lien I can place against his property?
Will I be able to recover damages if he sells before I recieve compensation?
He currently has a closing date of 5.24.99

So many issues and you wait until the 11th hour. (1) Who exactly owns the home? Is it a contractor or a homeowner. If a contractor, he/she/it should have a copy of his insurance on file at the village. It might be worthwhile to submit a claim to that company. (2) The village will usually repair damage caused by their plows. Have you made a formal request that they come out and repair? (3) If you file a lawsuit before the 24th, you will be able to file a Lis Pendens; however, you should know that Slander of Title can be an awesome counterclaim.
