Property Damage

Hello,

I'm a current 1st floor condo owner and the problem i'm having is with the 2nd floor tenant. They aparantly have some type of plumbing problem and i'm getting water from them on my bathrtoom ceiling. It has been going on for about 2 months now and I have tried numerous times to knock on their door while its happening but have never had the door answered. I have also contacted the condo association president several times and have even had him look at it but it has not been taken are of yet. I'm sure there is some damage done on the ceiling drywall already and I know if its not fixed it will get worse. I am seeking a legal approach since talking is not getting me anywhere. Can I do something for the property damages? If so how would I go about it? Any advice would help.

Your only remedy is against the association or the 2nd floor unit owner.

I would suggest suing both of them.

Dear Sir,

First of all, let me apologize for the delay in answering your question. You probably have a very good legal claim in your situation. Generally, condo tenants are responsible for damages to another unit that emanates from their unit. If you have insurance, you may be able to make a claim on it and let them pursue whoever is responsible. If not, the Association may have insurance that covers this situation. If the Association President is unwilling to help you with the Association insurance info, you may have to force his hand legally by hiring an attorney. If not, you may have to pursue legal action directly against your neighbor. Hopefully, this helps.
