Legal Question in Real Estate Law in Illinois

Property Damage Liability

I hired a company to cut down two large trees but in the process one of the tree's limb fell and hit my neighbor's siding. Only a minor scratch. I provided my neighbor with the tree service company's insurance which agreed to pay for the repair. However, my neighbor insisted on replacing the entire house's siding which the insurance company refused. Now they are both quiet. Am I liable to this property damage at all? Can they sue me in the future? What is the course of action should I take in the event of a lawsuit?. Please advice.

Re: Property Damage Liability

In theory, an argument can be made that the company was acting as your agent. You may want to contact your own homeowners insurer, although I doubt that there is coverage. Your neighbor is entitled to the cost of repair for the specific damage. If they sue you, contact an attorney.
