Property left on public roadway taken by neighbor

This is an issue of a neighbor taking our childs skateboading box off our street and burning it. I am taking him to small claims court. No criminal law was broken because it was located on temp public roadway easement. Unincoporated rural area on dead end street. Road commissoner was aware of our box and had no issues with it. Can i hold my neighbor responsible? He admitted to it, and refuses to reimburse us the cost to replace it. It was just a square box approx. 1 ft high for him to do tricks on. We had no complaints from him, neighbors,sheriff, or any other authority. Thank you.

He is liable to you for the costs and punitive damages if you can prove he knew it was yours and he did it on purpose. I would argue to the judge the cost of material and your labor at $10.00 an hour, and ask the judge for punitive damages of $100. and hope the judge likes skateboarders.
