Legal Question in Real Estate Law in Illinois
Former property manager not returning items, phone calls
I am the treasurer on the Board of our Condo Assoc. We had a contract with a management company May 1, 2006-April 30, 2007. Due to our dissatisfaction with the company, we did not renew the contract (we gave ample notice with a certified letter). In a nutshell, they still have our master key, tax paperwork (not even sure it's been filed) and apparently invoices for work performed by them that we need to pay. I have left dozens of messages on voice mail with the property manager and spoke with his assistant just as many times. He has not returned a single call in five months. I am at a loss as to how to proceed and get back what rightfully belongs to the Association. Is this something that we need to turn over to an attorney for resolution?

An attorney could begin with a strongly worded letter that may kick them into action. Otherwise, you will have to get into court to get an order to have them turn over your things.

I do a fair amount of real estate (residential and commercial) and have represented HO associations in the past, though not currently. The first step is to find a lawyer, retain that lawyer as the lawyer for the association, and then have that lawyer send a letter to the old entity demanding the return of the property that you described. I practice in Kane, Du Page, and some Municipal Districts of Cook County. Good Luck! Give me a call if need be. I'm here to help.
