Legal Question in Real Estate Law in Illinois
I have a question on closing on a HUD home. My husband and I won our bid for this house on August 16th, 2010. We have still not closed on this house! We have had around 10 to 15 different closings dates that keep getting pushed back because someone forgot to do something. We have paid for extensions even though we have been giving them everything they need and none of this is our fault. It has gotten to the point where I just think they do not care anymore; and I feel like this could go on forever. We love this house and just want to be happy. I was wondering if there is any legal action I can take?

Whether or not there are any options available to you depends on many factors. Who is the "someone" who "forgot to do something"? Who are the "they" that you refer to in your question? Your real estate attorney should be able to assist you in sorting this out and figuring out if any action is necessary.
Have your attorney ask the AM (which I believe is HMB, Inc. in Illinois) for the name and email address of their GTR or GTM. Then have your attorney ask the GTR or GTM what the hold up is. If that does not work, contact your Congressman. The congressional inquiry gets everybody excited, but it should be used as a last resort. Do not worry about what all the initials mean, the parties involved will know exactly what is being asked.
Apparently you don't have an attorney helping you. You need one. It sounds as though the place where you applied for your mortgage is incompetent, but perhaps not. There are so many newer requirements today that even the underwriters (the actual lenders that your loan person may be fronting for) are sometimes clueless. The difference between what used to be and what is now is almost as vast as the difference between a tube radio (ever heard of one?) and a digital PDA. Vast. Get some help on your side.
