Legal Question in Real Estate Law in Illinois
Real Estate Law Suit
My parents moved from IL to MI. The people who bought their house are sueing them for $13,000+, ''claiming'' the basement leaked (they had a storm, power failure & sump pump was off) after they moved in and my father was ''hiding'' the fact. The basement did leak when my mom & dad bought it, he fixed it, never leaked for 15 years after that. My parents lawyer said to settle out of court for $10,000. If they don't, he said it would cost atleast $5,000+ just to take it to court. My dad knows he is in the right, but they don't have any money to pay them or go to court. I am trying to come up with the money, if I don't, can they take possesion of my parents house? (It's paid for) Also, can they make payments on a law suit?

Re: Real Estate Law Suit
Many attorneys will work flexibly with payments. You need to consult with an attorney before you can state whether you have a case to defend or not. They still have to go to trial on the merits of the case and if they win get a judgment, etc. There are many parts to a lawsuit that have to be done before your case is over.
