Legal Question in Real Estate Law in Illinois
real estate
A relative in Illinois is in a nursing home and about to go on state support. His sister sold his home to her daughter and now wants me to buy the home. Is there going to be a problem with the state regarding his assets and the amount of time since they were sold?

Re: real estate
Big problem. The state has a 5 year look back ability. The house should have been put into a revokable living trust 5 years ago. However, if a relative lived in the house and took care of your relative for at least 2 years, they could make a case to keep the house. Check with an elder lawyer in Illinois in the county where the house is located.
