my son bought a house in oct 06. We are now having leakage in the basement not seepage but actual leaking this was not disclosed at the time, Can we ask the former owner to repair this. Also six week after moving in part of the basement ceiling fell in due to a leaking toiet

I'd need more information to give you proper legal advice, but one place to start would be the Residential Real Property Disclosure form that is part of every IL real estate contract. Basement flooding must be disclosed on it. If the basement flooding was not disclosed, it allows for some good remedies including having your attorneys fees paid.

You need to see an attorney in person for a review of the purchase agreement and the Residential Disclosure Form required in every purchase/sale of a residence. There may be a misreperentation or warranty that applies.
