real estate tax issue

I live in McHenry county IL.I paid cash

for my house in06/2007/and on

07/01/2009 I was served a summons

at 7am that my house was sold for

delinquent taxes for the year 2005.do I

have a case against the title co.?

Your best bet is to review your HUD,your deed,your contract, the title commitment and policy. Depending on what you find, there may be a cause of action against any or all of the following, or none at all; the title company, your closing attorney and/or the seller.

It depends. Remember, 2005 taxes became payable in 2006 in two installments payable in June and September. If you closed prior to June's property tax bill deadline, the title company may not have any liability. If you closed after June, they may have some liability if a taxbill was not paid and should have been paid up and through the date of closing.

It may be worth your while to contact the title company and see if their legal counsel can verify for you whether they properly paid, or did not have responsibility to pay, or what the situation was with regard to the property taxes.
