Legal Question in Real Estate Law in Illinois

We have received a foreclosure summons the same time we were told we were approved for the HAMP program, we have received the paperwork to sign and return and first payment due 2/1/12.

Do we still have to file an appearance on the summons?

ABSOLUTELY! One hand doesn't know what the other is doing and you must protect yourselves! You should get an attorney to communicate with the lender's FORECLOSURE attorneys to let them know what is going on, and if you are able to provide written confirmation of the refi that could result in the case being continued or dismissed without prejudice until the refi is accomplished that would be important because it it is ALSO very important that you preserve your right to redeem within the 90 days after filing in case the refi is delayed. THAT is why you should have an attorney do this and not DIY!!!!! Best of luck, many are with you.
