Legal Question in Real Estate Law in Illinois

Have not received security deposit

My roommate and I have been waiting for our security deposit checks for two months now. We had earlier received a letter stating some charges and the amount which we are due, but no checks. We have called numerous times, and they constantly say that the checks are in the mail, or that they will send them out that day, but we have nothing. Is there anything we can do besides calling them again? I live in a different state now so it is very difficult to go down to the landlord's office personally. The apartment we rented is in the city of Urbana.

Re: Have not received security deposit

You can remind the landlord that bad-faith failure to make refund can engender $600 in statutory damages. Then, if necessary, get a California small-claims self-help law book and study whether you can file and carry out a small-claims action. Generally this will require making at least one trip to California but perhaps you can tie that in with other business.
