Legal Question in Real Estate Law in Illinois

removal from a mortgage

Myself and my ex are both on the mortgage for our home. He agreed to refinance under his name and I would move, but he is not doing anything. Now I am financially responsible for a home that I am only living in part time. Is there anything that I can do to attempt to expedite this process? I want to make sure that anything he does will not effect my financial situation, but don't know if there is anything I can do at this point.

Re: removal from a mortgage

If your ex is your ex husband and the decree requires him to refinance, you may be bale to have him held in contempt. If you were not married, then you can file a partition law suit and sell the property, paying off the mortgage.
