Legal Question in Real Estate Law in Illinois

Rental Apartment

I am behind on my rent and I spoke to the property manager on a Friday and was told a certain amount to pay. I called back a Tuesday to pay that amount and I was told I would have to pay the whole amount. They will not take the amount they told me to pay. I haven't been served any evition paper. What can I do?

Re: Rental Apartment

Landlord is not required to accept any amount less than the full amount. I'd do my best to get caught-up. If not, the eviction is this: landlord files a lawsuit and you'd get served with legal documents by the Sheriff. There'd be a return court date where there would probably be a trial. If you'd lose, the landord gets what's called an Order of Protection. After court, this Order of Protection is then given to the Sheriff's office that actually does the physical removal. Some timeframes to consider...from time of filing case to first court date is at least 30ish days. Even if Order of Possession entered, from time OP is given to Sheriff to time they get out to property is at least 3/4 weeks. You might keep your eye on Cook Circuit Clerk Website...you can see online case information there as to whether or not a case has been filed.
