Legal Question in Real Estate Law in Illinois

Rights to a house owned by six

My mother and father pasted away and they left a house. They did not have a will. There are six children and we said that my oldest brother can live there untill he buys it. He did sign a piece of paper stating ''I, David by signing this document, agree to purchase the property located at_______. If said property is not closed by February 1, 2003 I agree that it should be placed on the market. He did sign it and we don't know if this is a legal document. We don't know what else to do.

I think that you should retain a lawyer. Even though your father and mother did not have wills, their estate can be probated. You should hire a lawyer sooner than later. GOOD LUCK.

It is possible that this document could be used against him as a promissory note of sorts, however, don't count on it. You should send the house to probate so that you all are ensured of your share of the estate.
