security deposit refund

Hello --

I have a tenant that is on a month to month lease and did not provide 30 day WRITTEN notice that they are moving. Am I required to refund their security deposit? Where can I find documentation on this?

Hello Grace -- If your tenant is on a month to month tenancy they must provide you with a month's notice. If they do not you can keep the security deposit [assuming its equal to one month's rent]. The authority is in the Illinois statutes and case. I can't quote you authority off the top of my head. Also remember that the security deposit can be used to place the apartment back in the same shape it was in, usual wear and tear accepted. If there isnt enough money to do this the tenant owes you. If this is the case you may have to look into a landlords lien on their property.
