Legal Question in Real Estate Law in Illinois

Security deposits

My landlord will not return my security deposit and is also claiming that I owe additional money for damages. Unfortunately I did not take pictures before leaving the apartment. I would like to take my landlord to small claims court. How should I prepare and is there any way to find out how many judgements this landlord has filed against tenants to show a pattern that this landlord does not return deposits?

Re: Security deposits

GREAT QUESTION! First, you can find out how many cases the landlord has been involved in by checking the Plaintiff/Defendant index at the Circuit Clerk's office. Second, you should know that if the landlord has more than a certain number of apartments, there is a statute that governs security deposits. Good Luck!
