Legal Question in Real Estate Law in Illinois

I am separated from my husband, we are not on speaking terms, we no longer live in the same state, do i absolutely need a homestead waiver in order for me to purchase a home?

This depends on your mortgage company; and in my experience, the answer is always going to be "yes". Why don't you put your ducks in a row, and file a petition to dissolve the marriage.
