Legal Question in Real Estate Law in Illinois

We had a short sale offer that was pending approval by the bank. The listing agent kept telling us to be patient - it would be approved any day. After waiting for four months, we discovered thru Zillow that the property had been sold to a 3rd party - a LLC. It sold days before our last false update. The listing agent cashed our earnest money check, admitted he "screwed up" and wrote us a NSF check. We are supposed to meet with him on Thursday along with our realtor's attorney. . I believe this is a flopping scam. I am disappointed that our Realtor did not check references and did not insist that the check be held in escrow. Internet search shows that this realtor has scammed before. Should we call the police? FBI? Attorney General's office?

You can report the broker and file a claim; there is a state fund for defrauded consumers. Check with the Illinois Department of Professional Regulation.
