Legal Question in Real Estate Law in Illinois
Squeaky floors above creating big problems
The condo owners above the unit I own are so loud when they walk that it has become inhabitable to be in my unit. I know the floors are bad, the whole building was a gut rehab project, but something has to be done. It is not just my subjective opinion when I say the noise is unbearable. I've had other neighbors, friends, and various objective opinions all agreeing the squeaks are unbelievable bad. I can hear every step they take and I wake up every night because of it. It sounds like thunder. Aside from attempting to resolve this with my neighbors, which I am in the process of (they might be installing new flooring) do I have any legal course of action against them? I mean it is their property, and it is creating an inhabitable environment in my condo. I know that floors squeak, especially in older buidlings, I've owed a few in the past. This, however, is on a whole other level. Can I take them to course shall they not budge on putting in new floors? Thank you.

Re: Squeaky floors above creating big problems
Hello. From your posting I am unable to determine the size of your condo
community, but in my opinion the condition of the floors should be a topic of discussion by the board of
directors. Under these circumstances I do not see a cause of action you can bring in court against your upstairs neighbors. Will be happy to discuss this further and in more detai.
