Legal Question in Real Estate Law in Illinois

Out of state Landlord - Eviction

I live out of state and need to begin the eviction process. Will I need to fly to my rental property to appear in court, or can a designated property manager appear for me? Will this affect the case? If I do have to travel to court, are the tenants responsible for the cost?

I would be careful with the "designated property manager" option, since this could involve the unauthorized practice of law. And a courtroom is really not a good place to engage in the unauthorized practice of law. You could certainly hire an attorney. Your tenants probably would not be responsible for your travel costs, unless there is a provision in this lease which allows this. More likely, there is an attorneys fee provision if you have a written lease. But honestly, if they are not paying their rent, they might not be able (or interested) in paying any other bills either.

If the property is in Illinois, your questions can only be answered by an Illinois attorney.

A FE&D is a county specific legal action. You should be represented by an attorney, who can minimize your personal appearance in court, unless absolutely necessary. I what county is the property? Is there a written lease? Advise.
